What is NOT an Education Record?
FERPA has a number of education records exceptions. These include but are not limited to:
– Sole possession records –Notes used only as a personal memory aid
(such as advisor notes) that are not shared with anyone.
– Medical Treatment records – These include but are not limited to records
maintained by physicians, psychiatrists and psychologists.
– Employment records when employment is not contingent on being a
student.
– Law Enforcement records used only for that purpose.
– Post attendance records, (e.g. (alumni records) that do not relate to the
person as a student).
